Prices and Rates
All prices quoted are in Australian dollars and inclusive of the Goods and Services Tax. All rates quoted are valid until 30th November 2008.
BOOKING CONDITIONS
Payments
By paying the deposit (or someone else in your group paying the deposit on your behalf) you acknowledge that you have read and agreed to be bound by these terms and conditions.
- To confirm your booking a 30% deposit (per person) must be paid at the time of booking.
- Full payment must be received at least 30 days prior to arrival. If full payment is not received by the due date, Cape Don Pty Ltd (trading as Cape Don Experience) (Cape Don Experience) reserves the right to cancel the booking, in which case the deposit will be forfeited.
- In the event that the number of participants in your group reduce below that originally booked, Cape Don Experience reserves the right to re-price the group booking.
- If you decide during your trip to cut your stay short the full cost of the trip will still be payable.
- Where a person makes a booking on behalf of a group, that person must ensure that all group members are made aware of these terms and conditions.
- Payments (including deposits) may be made via bank transfer, cheque, money order or credit card. As you are aware the various credit card companies, including (without limitation) Visa and Master Card, charge Cape Don Experience in respect of credit card transactions (currently 3% of the value of transaction). Cape Don Experience reserves the right to pass on this charge. Note this does not apply to direct transfers, cheques or money orders.
Changes to the Booking
In the event that Cape Don Experience needs to reschedule a booking due to dangerous weather conditions or for any other reason beyond our reasonable control you will be notified as soon as practicably. Rescheduled trips must be commenced within 12 months of the original booking date.
Cancellation Conditions
If you cancel your trip, you must do so by writing, and the following fees will be charged;
- if the trip is cancelled 30 days or more before arrival, 30% cancellation fee of the total booking fee is payable
- if the trip is cancelled between 7 days to 29 days before scheduled arrival, a cancellation fee equal to 50% of the total booking fee is payable
- if the trip is cancelled less than 7 days before scheduled arrival, if no written notice of cancellation is given, or if you do not otherwise arrive by the time schedule for arrival, a cancellation fee equal to 100% of the total booking fee is payable.
Refunds
Refunds will not be given once the trip has commenced
Standard Inclusions
- Return flights from Darwin to Cape Don
- Accommodation on a single, double triple or quadruple share basis
- All meals and non alcoholic drinks (excluding mixer drinks) at Cape Don
- Park entry permit fees
- Use of fishing equipment
- Services of professional fishing guide(s)
Exclusions
- Alcohol
- Travel Insurance
- Domestic travel to Darwin from other cities or towns
- Accommodation and meals whilst in Darwin
Travel Insurance
We strongly recommend that guests purchase travel insurance that will cover cancellations for events such as illness, family crisis or other emergency.
Cape Don Experience is not responsible for any loss or damage to baggage or personal items. Guests must bear the cost of any medical emergency service required in the event of illness or injury.
Fishing Tackle
Fishing rods, reels and tackle are supplied for your use by Cape Don Experience. We have a limited supply of fly fishing equipment available. Please contact Cape Don Experience prior to your trip if you intend on fly fishing. Where we receive sufficient notice we will endeavour to have the correct fly fishing equipment on hand for your trip.
All fishing equipment and tackle for the trip is on a ‘replace if lost or damaged’ basis, payable at the end of your stay. We encourage people to bring their own fishing equipment and tackle if it is suited to the type of fishing. We can advise you of what you will need.
Catch and Release
Cape Don Experience promotes ‘catch and release’ fishing. Enough fish will be kept for the evening’s meal and all excess fish will be released.
Baggage Limit
Please keep baggage to a maximum of 10kg. All due care will be taken, but no responsibility is accepted by Cape Don Experience for the loss or damage of any luggage (however caused).
Fitness
Cape Don Experience operates in a remote and rugged location. Guests must be in good health and have a reasonable degree of fitness. Cape Don Experience may request a medical certificate prior or during the trip to ascertain that the participant is of sound medical condition.
If in the opinion of Cape Don Experience’s Management, the participant is not of sound medical condition, Cape Don Experience may require that the participant cease the trip. Cape Don Experience is not liable for any direct or indirect losses incurred by the participant as a consequence of the early termination of the trip.
You must advise Cape Don Experience’s representatives prior to arrival of any special medical conditions and dietary requirements that you may have.
Liability
In accepting these terms and conditions you:
- acknowledge the Cobourg Peninsular, NT is in a very remote area and potentially dangerous;
- accept all risks necessarily arising from or in connection with your trip which could result in loss of life, injury, damage or loss of any description which you may suffer or sustain in the course of or consequence upon undertaking the trip (including, without limitation, if you are not in sound medical condition); and
- release Cape Don Experience and its respective officers, agents, contractors and employees (those released) from all claims, demands, liability, costs and expenses arising out of your trip and you indemnify those released against all liability (including for negligence) for all injury, loss or damage arising out of or connected with your trip the extent permitted by law.
Warranty Disclaimer
Cape Don experience makes no representation, express or implied, as to fishing conditions. Adverse weather, tidal conditions and other factors may affect fishing conditions (including the ability to fish in certain areas and the number and species of fish caught.
Guest’s Responsibilities
As a guest of Cape Don Experience you must:
- comply with all reasonable directions given by Cape Don Experience’s Management and Staff
- conduct yourself in an appropriate manner
- not endanger or cause discomfort to the other guests
Cape Don Experience reserves the right to remove guests who fail to meet their responsibilities as a guest. Cape Don Experience is not liable for any loss, costs or expenses incurred by a guest where a trip is cancelled in those circumstances. In addition where a trip is cancelled as a result of the misbehaviour of a guest, the guest may be liable to compensate Cape Don Experience for any loss suffered as a consequence.
